Introduction

Lending Software Solutions Pty Limited t/a LendingMetrics (“LendingMetrics”) respects your privacy and is committed to protecting your personal data.

The Privacy Acy 1988 and Australian Privacy Principle (APP) 5 requires that LendingMetrics has a privacy policy.  This privacy policy will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about what information we collect, why we collect this information and how we handle it.

This privacy notice does not apply to any personal information we process on behalf of our business clients when we provide services.  The contracts that we have with our clients control how we process personal information in this context.  If you are a client of one of LendingMetrics’ business clients and have questions about your personal information, we suggest that you contact the business client in the first instance and if needed, we will provide assistance to them in responding to your queries.

About us

LendingMetrics is registered in Australia under number ACN 169 826 911.  Our registered office is 30 Cruse Road, Belhus WA 6069. We also have an office in the United Kingdom (details below) and so we also comply with the UK retained General Data Protection Regulations. 

Information we collect

We may collect personal information about you when its reasonably necessary for, or directly related to, our services or activities.  Personal information is defined in the Privacy Act as information or an opinion about an identified individual who is reasonably identifiable.

The kinds of information we may collect includes:

  • Name
  • Address
  • Gender
  • Date of birth
  • Contact details
  • Employment status and history
  • Financial situation
  • Unique identifying information
  • Feedback and complaints
  • Website browsing data

We may also collect personal information about you from third parties.  We do this to verify the information you have provided or to gather additional information about you to help deliver our services.  The third parties may include:

  • Fraud prevention or credit reporting agencies
  • Data brokers
  • Banks and financial institutions
  • Analytics providers (such as Google Analytics)
  • Publicly available internet sources

We may collect sensitive information about you:

  • Where you consent
  • When the collection is authorised or required by law
  • The collection is otherwise allowed under the Privacy Act.

How we collect information

We collect your personal information through a variety of channels. This includes direct interactions, automated technologies/interactions or from various third parties and public sources such as business directories, public registers and other commercially or publicly available sources.  When your personal information is collected from a third party, we take steps to inform you. This may occur through this Privacy Policy or discussions with LendingMetrics employees.

We may exchange data with other agencies as part of the provision of services.  We do this in accordance with relevant legislation, including the Privacy Act, to collect accurate and up to date information about customers.  We may also assist other agencies to exchange data.

At all times, we aim to collect only the information we need for the particular function or activity we are carrying out.  We may not be able to provide the assistance or service if you do not provide us with the personal information when we request it.

Why we collect information

We may collect your personal information when it is reasonably necessary for provision of services or because we are required by law to collect it.

For example, we may collect your personal information to:

  • Confirm your identity
  • Communicate with you
  • Manage feedback and complaints
  • Manage and respond to requests for information
  • Help us assist our business clients (for example, the assessment of credit applications and credit worthiness)

How we use personal information

We generally use personal information only for the purpose we collect it, unless you consent to us using or disclosing it for a different purpose. 

Sometimes we may use or disclose your personal information in circumstances where you would reasonably expect us to use or disclose it, the Privacy Act permits the disclosure, and it is impracticable to obtain your consent.

We will take reasonable steps to ensure that any third parties who receive your personal information from LendingMetrics are bound by substantially similar privacy standards and obligations as LendingMetrics.

How we store personal information

We take reasonable steps to protect your personal information against misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include:

  • Storing records securely as per Australian government security guidelines
  • Only accessing personal information on a need-to-know basis and by authorised personnel
  • Secure data centres which can only be accessed by authenticated credentials
  • Regularly updating and auditing our storage and data security systems.

When no longer required, we destroy personal information in a secure manner.

We may gather and store personal information on behalf of other companies, including in our data warehouse.  We keep such personal information separate from our own data and protect it with strict and secure access controls. We store data in secure physical data centers or a serverless provider on request.

How we share information outside Australia

We may disclosure your personal information overseas, primarily to the United Kingdom where our second office is located, where:

  • The disclosure is required or authorised by law
  • The disclosure is required for the performance of a contract
  • You have given consent (express or implied from circumstances)

How to access and correct personal information

You have the right to:

  • Ask for access to the personal information that we hold about you and an explanation about the processing
  • Withdraw any consent previously granted
  • Request correction, amendment, restriction, anonymization or deletion of your personal data

If you ask we must give you access to your personal information and take reasonable steps to correct it if you consider it is incorrect, unless there is a law that allows or requires us not to.  We will notify you in writing and explain our reasons if we refuse to give you access to, or correct, your personal information.  We aim to respond within 30 days.

How to opt out

Subscription communications include email newsletters, product updates, etc that may be expressly requested by you or which you consented to receive.

You may opt out of receiving these general communications by using one of the following methods:

  • Select the email’s “Opt out” or “Unsubscribe” link, or follow the instructions included in each email subscription communication.
  • Contacting us via email (info@lendingmetrics.com)

We will take reasonable steps to ensure compliance with the Spam Act 2003 which prohibits the sending of unsolicited commercial electronic messages.

Cookies
